1. Refund Procedure:

We hope to ensure your experience with davenport’s chocolates is entirely fabulous as we take great care and pride in our handcrafted chocolates. However, should you not be entirely satisfied, please contact us and we will do our best to rectify the situation. If the products we deliver are not what you ordered, are damaged or defective, or you did not receive them, we will refund or replace them at our discretion. You may only cancel your order if you contact us before your order has been dispatched; in this event any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible, and in any event within 30 days of your order. This right of cancellation does not apply to bespoke or corporate orders (please see section 5 for more details).

However, we shall not have any other liability to you regarding the purchase of our chocolates. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products.You must notify us of any problem within 7 days of receipt of purchase.

2. Delivery:

Our delivery charge is £2.95 per purchase for a single item, or £4.50 for 2 or more items (including VAT), and FREE on any spend of £30 or more (subtotal before discounts are applied). Our single item gift boxes are ‘letterbox friendly’ and will fit through most letter boxes, allowing you to receive the parcel in your absence.

Orders are processed Monday-Friday only. Your order will be processed the following working day. Should there be any delay to your order we will contact you with the details. In the unlikely event that your order is out of stock following the time your order was placed - we will contact you to offer you a refund or alternative.

We use Royal Mail 48 hour service for a prompt and economical delivery. Though for orders over 2kg total weight we may also use a courier service. (We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation to, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.).

We will deliver the products ordered by you to the address you give us for delivery at the time you make your order. It is, however, your responsibility to provide us with accurate delivery address details. We will not check or verify addresses and messages supplied by you.

You will become the owner of the products you have ordered when they have been delivered to you. Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

We currently deliver to addresses in the UK only.

3. Payment:

We must receive payment of the whole of the price for the products that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in the order form. Our acceptance of your order brings into existence a legally binding contract between us.

We accept payment online by credit and debit card using Realex payment gateway, which allows us to collect payment as securely as possible. For further information, please visit www.realexpayments.co.uk/.
At no time will Davenport’s Chocolates store your credit or debit card details.

If you have a promotional or discount code, you must enter this on the shopping basket page before proceeding to the checkout page. Codes must be used within any validity dates specified. Only one code can be used per transaction. All our ‘money off’ or percentage discounts are applied to the total cost (inc VAT) before delivery charges are added.

Our 3 for 2 offers give you the 3rd, 6th and 9th etc most expensive item free.

All prices include VAT at 20%. (Or the current rate if different to figure shown here).

4. Security:

Security is a major issue for anyone purchasing on the internet. You need to know that a website is legitimate, and transactions are secure before you buy. Please be assured that our entire website including the “Checkout” page (the only page where card details are entered) uses an SSL (‘secure sockets layer’) and a secure connection. This is evidenced by each page URL being prefixed with “https” (hypertext transfer protocol secure). Please also note the pad lock symbol that may appear in your browser bar to indicate this. Any information you enter on any page is encrypted.

5. Corporate, Wedding & Bespoke Orders:

All corporate, wedding and bespoke orders are priced on an individual basis, please apply for a quote for bespoke chocolates, artwork and associated costs.

All necessary artwork must be received by us at least 28 days before the intended delivery date of the products, and must conform to the specifications supplied by Davenport’s Chocolates.

We have your permission to use your artwork and logos for the purposes of printing and fulfilling the order.

The design and layout of the artwork must be approved by an authorised person within your business prior to any printing being carried out.

All bespoke orders of any nature (either artwork or chocolates) require a 50% deposit of the total order to be paid before work commences. The deposit is non-refundable if the order is cancelled by the purchaser. Payment is to be received in full before the good will be dispatched.

Davenport’s Chocolates reserve the right to refuse bespoke orders at our discretion.

6. Privacy Statement:

Davenport’s Chocolates are committed to ensuring that your privacy is protected and that we fully comply at all times with the General Data Protection Regulation (2018).

How we use the information we collect:
When you order our products we need to know your name, postal address, e-mail address, telephone number. If you have ordered products for a third party we will need to know their postal address. We gather this information to allow us to process any orders you may make. The relevant information is then used by us for delivery purposes, and to contact you on any matter relating to your account and the provision of our service. We do not store your payment details. We do not pass your details on to any third parties other than for processing of payment (see above) and for optional email subscription as listed below.

My Davenport’s Account
You do not have to register for an account with us to be able to place orders, however you may do so to save your details and make future orders even easier. We maintain a database to plan and manage our business activities, including analyzing shoppers’ habits and preferences. If you have an account with us, you can update your details and preferences at anytime by logging in, then clicking the ‘My Davenports’ link at the top right of our web pages. If you would like us to delete your account information, please email info@davenportschocolates.co.uk to let us know.

Mailing list subscription
If you have signed up to our customer mailing list, we will occasionally send you information about our business, including offers, updates and product marketing (you must be over 16 to sign up to this service). In this instance, selected data is passed to MailChimp, whose services we use to send email updates. You can opt out of this service anytime by clicking the ‘unsubscribe’ links on the bottom of any customer mailer, or by emailing info@davenportschocolates.co.uk using ‘unsubscribe’ in the subject.

7. 'Chocolates are for Sharing' promotion

Davenports offer the chance to send a free small gift box of our chocolates when an order fulfills certain criteria. Each 'chocolates are for sharing' promotion is subject to review and approval. Davenports reserves the right to withdraw this offer on a case by case basis at any time, without notice.

Qualifying orders will be those: completed for £19 or more, by customers signed up to our mailing list, sent exclusively to new Davenports customers, new Davenports customers must sign up to our mailing list to claim the free gift box being 'shared'. This promotion can not be used at the same time as redeeming a promtional discount code.

Legitimate email details must be used for both the sharer and the recipient. Invalid contact details will result in the offer being withdrawn and not re-extended. Customers will be responsible for accuracy of the address given for delivery at the time the offer is redeemed. We will not check or verify addresses and messages supplied by you.

8. Miscellaneous:

Please be aware that all our products may contain traces of nuts. Please email us if you require more detailed dietary information on any of our products.

You are not permitted to sell and must not offer for sale or re-sell any of our products.

We reserve the right to cancel the contract between us if we have insufficient stock to deliver the products you have ordered. If this is the case, we will contact you to advise of an availability date or to offer you a substitute product.

A cookie is an alphanumeric identifier which we transfer to your hard drive through your web browser when you visit our website. It enables our own system to recognise you when you visit our website again and improve our service to you. Cookies may also be used to compile aggregate information about areas of our website that are visited most frequently. This traffic information can be used to enhance the content of our website and make your use of it easier. If you wish to reject our cookie, you can configure your browser to do so.

The content of this website is protected by copyright and intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website in whole or part without written permission from Davenport’s Chocolates.

You agree not to use this website in any way which causes any part of the website to be interrupted, damaged, rendered less effective or in any way impaired. You will not use this website to transmit or post any material which is defamatory, offensive, of an obscene or menacing character, or which may, in our judgment, cause annoyance, inconvenience or anxiety to any person.
